Introduction
1. The Fitness Studio & Crome Fitness Ltd, 44-45 Innisfree House, High Street, Sligo, tfssligo@gmail.com & info@cromefitness.com.
2. Offering fitness classes, personal training, health & nutritional guidance, training packages, & personalised plans.
Eligibility for Participation
1. Minimum Age Requirement:
Clients must be 18 years or older to register independently. Participants under the age of 18 must have a parent or legal guardian complete all waiver and consent forms and may only participate in age-appropriate sessions as determined by TFS & Crome Fitness Ltd. staff.
2. Health & Medical Clearance:
All participants must:
Complete and sign a Physical Activity Readiness Questionnaire (PAR-Q) before their first session.
Disclose any existing medical conditions, injuries, or medications that may affect participation.
Seek medical clearance from a GP or relevant healthcare provider if any risks are identified on the PAR-Q or during consultation.
We reserve the right to request written medical clearance where necessary.
3. Ongoing Health Obligations:
Clients agree to inform TFS & Crome Fitness Ltd. of any changes to their physical or mental health that may affect their ability to participate safely. Failure to disclose relevant information may result in suspension or termination of services.
4. Instructor Discretion:
TFS Crome Fitness Ltd. reserves the right to:
Deny participation in any class or service if a client is deemed unfit, disruptive, or unsafe for themselves or others.
Refer clients to medical professionals before continuing sessions.
This applies whether or not a formal diagnosis exists, and includes behaviour or conditions that interfere with the safe delivery of fitness services.
5. Code of Conduct:
Eligibility is contingent on adherence to the studio’s Code of Conduct. Any breach, including harassment, dishonesty, or disruption, may result in immediate removal and permanent ineligibility for future participation.
Payments & Fees
1. Payment Requirement:
All sessions, memberships, and services must be paid for in advance unless explicitly agreed otherwise in writing by TFS & Crome Fitness Ltd.
2. Price Changes:
We reserve the right to adjust our pricing. Clients will be given at least 10 days' notice of any changes to rates for classes, memberships, or services.
3. Refund Policy:
All payments are non-refundable, except in cases where services are cancelled by TFS & Crome Fitness Ltd. or under extenuating circumstances assessed at our discretion.
Plans & Packages may be refunded at the expense of the full price of each session attended.
4. Missed Sessions:
Clients who miss a class or session without giving proper notice will not be entitled to a refund or reschedule, unless otherwise agreed upon in advance.
5. Package Expiry & Usage:
Class packs, sessions, and memberships must be used within their specified timeframe. Extensions are not guaranteed and are considered only for medical reasons or emergencies with appropriate documentation.
6. Late or Failed Payments:
Failure to pay by the due date may result in the suspension or termination of services. Repeated missed payments may result in permanent account restrictions.
7. Discounts & Offers:
Promotional offers or discounts must be used within the stated period and cannot be combined unless explicitly specified. Abuse of offers may result in ineligibility for future promotions.
Cancellations & Refunds
1. Client Cancellations:
Clients must provide a minimum of 4 hours’ notice to cancel or reschedule a booked session or class. Failure to do so will result in the session being forfeited without refund.
2. Membership & Package Cancellations:​

Packages & plans can be cancelled at any time by the subscriber or staff & refunded at the full expense of each session attended with the package.
3. Refund Eligibility:
Refunds are only issued under exceptional circumstances and are assessed case-by-case at the sole discretion of TFS & Crome Fitness Ltd. All refund requests must be submitted in writing with relevant details and/or documentation.
4. Studio Cancellations:
In the rare case that a class, session, or service is cancelled by TFS & Crome Fitness Ltd., clients will be offered the option to reschedule or receive credit for the missed service. Refunds may be issued if neither option is suitable.
5. No-Show Policy:
Clients who fail to attend a booked class or appointment without prior notice will be marked as a no-show and will not be eligible for a refund or credit.
6. Illness & Emergencies:
We understand life happens. Clients who miss sessions due to medical emergencies or illness must provide notice and may be asked to submit supporting documentation to be considered for credit or rescheduling.
Class & Session Access
1. Booking Requirement:
All clients must book in advance to secure a place in any class, session, or service. Walk-ins are not guaranteed access and may be turned away if capacity has been reached.
2. Attendance & Punctuality:
Clients are expected to arrive on time for all sessions. Late arrivals may be denied entry if the instructor determines that joining the session would be disruptive or unsafe.
Repeated late arrivals may result in temporary or permanent suspension from booking privileges.
3. Check-In Protocol:
Clients must check in with a staff member or via the designated system before entering the studio. For group classes, this typically occurs at the studio entrance and must be completed before the class begins.
4. Capacity Limits:
All sessions are subject to a maximum participant limit to ensure safety and quality of instruction. Once a class is full, no further participants will be admitted.
5. Waitlist & Standby Policy:
If a class is fully booked, clients may join a waitlist. If a space becomes available, the next eligible client will be notified and given a short window to confirm attendance. Unclaimed spots may be offered to standby clients onsite.
6. Access Refusal:
TFS & Crome Fitness Ltd. reserves the right to refuse access to any class or session if a client:

Has not met payment or eligibility requirements.

Fails to comply with Code of Conduct or safety protocols.

Is under the influence of drugs or alcohol.
-
Displays aggressive, inappropriate, or disruptive behaviour.
7. Studio Access Outside of Sessions:
Clients are only permitted in studio areas during scheduled sessions or with prior staff permission. Unauthorised access is strictly prohibited.
8. Plan & Package Breach Policy:
Continued Access to Future Packages is contingent on adherence to the terms, conditions, and code of conduct for your current plan. Failure to comply - such as repeated no-shows, late cancellations, or inappropriate conduct - may result in limited access or exclusion from future packages or promotions. These actions are at the sole discretion of TFS & Crome Fitness Ltd. and are implemented to maintain fairness and service quality for all clients.
Safety & Conduct
1. Client Responsibility:
Clients are expected to:

Follow all instructions provided by staff and instructors.

Use equipment only as instructed and for its intended purpose.

Wear appropriate workout attire and footwear at all times.
-
Refrain from any actions that may endanger themselves or others.
2. Instructor Authority:
Instructors have the right to:

Modify or stop a client’s activity if they observe signs of risk or injury.

Remove any participant from a session if they believe safety is compromised.
-
Enforce rest periods or technique corrections as needed.
3. Cleanliness & Hygiene:
To maintain a safe and welcoming environment, all clients must:

Wipe down equipment after use.
-
Bring a towel and water to all sessions.
-
Avoid attending if unwell or showing symptoms of contagious illness.
4. Environment Safety:
TFS & Crome Fitness Ltd. takes all reasonable steps to ensure the safety of the studio, equipment, and environment. Clients must report:

Any faulty equipment.
-
Slippery surfaces or hazards.
-
Any incident or injury, no matter how minor.
5. Behavioural Standards:
The studio maintains a zero-tolerance policy for:

Harassment, discrimination, or intimidation of any kind.
-
Disruptive or aggressive behaviour.
-
Inappropriate language or conduct towards staff or fellow clients.
6. Drugs & Alcohol:
Clients may not attend any session while under the influence of alcohol, illegal substances, or medications that impair physical performance. Doing so may result in immediate removal and further disciplinary action.
Emergency Procedure:
In the event of an emergency:

Clients must follow staff instructions promptly.

Evacuation procedures will be clearly explained and rehearsed as needed.

First aid and emergency contact information will be on file and accessible.
6. Disciplinary Action:
Staff reserve the right to restrict or terminate a client’s participation with The Fitness Studio & Crome Fitness Ltd. if they breach company policy or engage in misconduct as outlined in these Terms & Conditions.
This may include, but is not limited to:

Restricted access to services or packages

For a specified term or permanently at the discretion of staff​

Blocking use of the website or access to TFS property
-
Exclusion from events, lottos, and other TFS features
Limitation of Liability
1. Assumption of Risk:
By participating in any service provided by TFS & Crome Fitness Ltd., clients acknowledge that physical exercise involves inherent risks. These include, but are not limited to, injury, illness, muscle strain, cardiovascular complications, or even death. Clients voluntarily assume all risks related to participation.
2. Personal Responsibility:
Clients agree to use their own judgment when deciding to engage in classes or programs. It is the client’s responsibility to ensure they are physically and mentally fit to participate. TFS & Crome Fitness Ltd. will not be held liable for any injuries or health issues that occur as a result of undisclosed conditions, reckless conduct, or misuse of equipment.
3. Property & Belongings:
We are not liable for loss, theft, or damage to personal belongings on the premises. Clients are advised not to bring valuables into the studio.
4. Indirect & Consequential Losses:
To the maximum extent permitted by law, TFS & Crome Fitness Ltd. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including but not limited to loss of income, business disruption, emotional distress, or reputational damage.
5. Maximum Liability:
In any event, the total liability of TFS & Crome Fitness Ltd., whether in contract, tort, or otherwise, shall not exceed the total amount paid by the client for services in the twelve (12) weeks preceding the event giving rise to the claim.
6. Third Party Services:
We may refer or connect you to third-party services (e.g., guest instructors, retreats, therapists). We are not responsible for the actions, omissions, or outcomes of these third parties.
Assumption of Risk & Waiver Acknowledgement
1. Voluntary Participation:
Clients acknowledge that their participation in any service, class, or program offered by TFS & Crome Fitness Ltd. is entirely voluntary. They understand the physical nature of such services and confirm that they are engaging at their own risk.
2. Understanding of Risks:
Clients confirm that they understand the risks involved in physical training, including potential for injury, illness, or medical complications. They accept full responsibility for any consequences that may arise as a result of participation, whether foreseen or unforeseen.
3. Waiver of Claims:
By participating, clients expressly waive any and all claims, now or in the future, against TFS & Crome Fitness Ltd., its directors, employees, agents, or contractors, for any injury, loss, or damage incurred through participation.
4. Binding Agreement:
This assumption of risk and waiver remains in effect for the duration of the client’s engagement with TFS & Crome Fitness Ltd., including all classes, consultations, events, and services, whether in-person or virtual.
5. Waiver Form Reference:
All clients are required to sign a formal Waiver & Release of Liability Form prior to participation. By signing, the client confirms they have read, understood, and agreed to all terms contained within that form and this document.
Privacy Policy Summary

Under applicable data protection laws (including GDPR), clients have the right to:

Changes to Terms
TFS & Crome Fitness Ltd. reserves the right to update, amend, or modify these Terms & Conditions at any time to reflect changes in legal requirements, service offerings, or business operations.

Where possible, we will provide reasonable notice of significant changes via email, our website, or in-studio announcements. -
Client Responsibility:
Continued use of our services after any changes are published constitutes acceptance of the revised terms. It is the client's responsibility to review the Terms & Conditions periodically. -
